Two Lawsuits Against D.L. Blair and the Daily News Dismissed

Two New York judges last week dismissed two separate suits against D.L. Blair and the New York Daily News over a printing error in the newspaper’s Scratch n’ Match game.

A typing error at Blair caused the Daily News to print one wrong number in a string of 10 numbers for the March 19 match-and-win game. As many as 200,000 readers thought they had won a portion of the $100,000 jackpot. The error triggered protests outside Daily News headquarters in New York (March 23 Xtra). Garden City, NY-based Blair, which administers the game, took responsibility for the error.

A handful of additional lawsuits regarding the March game are still pending, said Daily News spokesperson Eileen Murphy.

The two separate lawsuits were filed in Nassau and Bronx counties in an effort to force the defendants to pay the full jackpot to game piece holders. The suit filed in Bronx County included a request for an injunction to stop the July 8 drawing for a $1 million prize pool. That request for injunction and both cases were dismissed, said Blair Chairman Tom Conlon.

The make-good drawing—which is standard procedure when a printing error voids a sweepstakes—will award 12,800 cash prizes that total $1 million. It will proceed as planned on July 8, Conlon said.
