JupiterResearch Finds One-Third of E-mailers Not Can-Spam Compliant

More than 33% of the e-mail marketers surveyed by JupiterResearch do not follow the dictates of the federal Can-Spam Act, according to the New York-based company.

While the majority of the 50 companies JupiterResearch tracked did provide a working opt-out mechanism, the marketers came up wanting on a number of other criteria.

For instance, only 64% of the senders included their street address, as required by Can-Spam, and nearly 25% continued to send messages after receiving opt-out requests. Another 16% send messages after the 10-business-day period.

One quarter indicated that they ran their e-mail opt-out suppression files either monthly, quarterly or never, in violation of the Act. Only 14% were in compliance, indicating that they honor requests for opt-outs either automatically or within the hour.
