A U.S. district court last month barred a Lake Tahoe, CA company from claiming it can register consumers on do-not-call lists for a fee.
The Federal Trade Commission filed its complaint against Ken Chase, doing business as Free Do Not Call List.org (FDNCL.org) and National Do Not Call List.us (NDNCL.us), in early May. While Chase already has refunded a total of nearly $3,800 to 254 consumers who registered at his site, the court order required him to verify all refunds and provide the FTC with a list of subscribers. Chase also is prohibited from sharing information about any of the customers who signed up for his service with anyone other than the FTC.
In an interview with Direct, Chase noted the registration program was only one of several products offered on his site. The sign-up offer was discontinued when the federal rules were changed and third parties were barred from submitting names to the do-not-call file, he said. Chase noted that other features of his sites include links to the national do-not-call registry and equipment for sale to help consumers discourage telemarketers.
