The U.S. District Court for the Southern District of New York has issued a permanent injunction against Procter & Gamble, prohibiting it from saying in direct mail and other promotional material that its Tampax Pearl tampons are superior in any way to those made by Playtex Products.
The judge also ordered P&G to notify its distributors, wholesalers and retailers to stop displaying anything that makes the false claims.
In addition, Playtex said it has filed a patent infringement case against Procter & Gamble in Federal Court in Cincinnati, which is scheduled for trial in August.
Procter Gamble reportedly said it was complying with the judge’s order.
