EU Lawyer Advocates Online Drug Sales

An advisor to the European Court of Justice said pharmacies should be allowed to sell prescription medicines over the Internet throughout the 15-nation European Union, according to wire service reports

Dutch online drug marketer 0800 DocMorris NV has challenged a German law preventing it from selling drugs to German patients, the report said.

Advocate General Christine Stix-Hackl said a German ban on the mail order or online trade of medicines was “a barrier to the free movement of goods.”

The opinion of the advocate general is non-binding, but the court, charged with ruling whether national legislation complies with EU law, follows it in 80% of cases.
