Harry and David Sues E-Marketer Over Trademark

Harry and David has sued Anshu Pathak to stop him from using its trademark phrase, “Fruit of the Month Club, according to wire service reports.

Pathak, a California businessman, has a Web business called Exotic Fruit Co. and owns a number of Web domains, including fruitsofthemonthclub.com and organicfruitofthemonthclub.com.

Harry and David, the direct marketer, said Web addresses could be confused with Harry & David’s Web site, harryanddavid.com, and has filed a federal lawsuit against Pathak for allegedly infringing on the company’s trademark slogan.

Pathak denies the company’s accusations.
